At this point, the mediation can be scheduled. During the mediation, each party and their representing attorney (if applicable) will be met with separately in individual private rooms.
The mediator will work with each side to determine their goals and how a settlement might be reached. During the scheduled mediation, the mediator will travel between rooms to communicate each party’s request. The objective is for a settlement to be achieved, but this process is entirely voluntary.
A settlement may or may not be reached during mediation. In the event, one or both parties fails to settle the dispute in mediation, the case may continue in court; however, a settlement can minimize costs and bring the dispute to a close without court proceedings.
